Waco SJ Ruling on Exhaustion/Licensing Issues

But there’s a catch.

The case is Innovative Foundry Technologies LLC v. Semiconductor Manufacturing International Corporation et al, 6:19cv0719. Judge Albright held a motion hearing on August 18 on Docket # 103, the Motion for Summary Judgment of Noninfringement due to Patent Exhaustion and Licensing filed by Defendant DISH Network Corporation.

As the attached text order reflects, the court partially denied and partially carried the motion. What was denied and why isn’t recorded, but if you’re dealing with patent exhaustion or licensing issues, you might want to consult the briefing and order the transcript – the court reporter is identified in the text order.
